Power Source Terms of Use

1. Agreeing to these Terms

These Terms of Use ("Terms") are an agreement between you and Flower Power Health LLC ("Flower Power Health," "we," "us") about your use of Power Source (the "App"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the App.

2. What Power Source is

Power Source is a weekly reflection and planning tool. Each week you can enter a few numbers from your devices or your own estimates, reflect on how the week went, plan the week ahead, and name your priority. The App shows your trends and gives you an AI-written summary.

3. Not medical care

Power Source is a coaching and reflection tool. It does not provide medical care, medical advice, diagnosis, or treatment. Nothing in the App, including AI-written summaries, trends, or messages from your coach through the App, is a substitute for advice from a qualified healthcare professional. Using the App does not create a clinician–patient or provider–patient relationship with anyone, including any member of Flower Power Health who holds a clinical license. Talk with your healthcare provider before starting or changing an exercise, sleep, or nutrition routine, and about any symptoms, injuries, or health concerns. Never ignore or delay professional advice because of something in the App. If you have a medical emergency, call 911 or your local emergency number. If you are in crisis or thinking about harming yourself, call or text 988 (in the US) to reach the Suicide & Crisis Lifeline.

Numbers you enter from wearable devices are estimates made by those devices. They are not medical measurements, and the App does not check their accuracy.

4. AI-written summaries

Your weekly summary is created automatically by an AI model (Claude, provided by Anthropic) from what you enter. No person reviews it before you see it. AI can be wrong, incomplete, or misread what you wrote. Use your own judgment, and don't rely on a summary for decisions about your health. You agree to AI-written summaries before your first one is created. If you do not wish to see AI written summaries, do not use the “integration” feature.

5. Who can use Power Source

You must be at least 18 years old and able to enter into a binding agreement. You may use the App only for yourself, not on behalf of another person.

6. Your account

You sign in with a link sent to your email address. Keep access to your email secure. You are responsible for activity in your account. Tell us right away at elizabeth@flowerpower.health if you think someone else has accessed it.

7. Your content

You own what you enter in the App ("Your Content"). You give us a limited license to store, process, display, and transmit Your Content only to provide the App to you: for example, to save it, calculate your trends, send it to our AI provider to write your summary, and show it to your coach if you turn on sharing. This license ends when you delete Your Content or your account, except for copies we must keep by law or that remain in backups for a limited time, as described in our Privacy Policy.

Please enter only information about yourself, and don't enter medical records, diagnoses, or other people's personal information.

8. Coaching and coach sharing

Sharing your field notes with your coach is optional and off by default. You can turn it on or off at any time in Settings. Coaching services are provided under a separate coaching agreement with Flower Power Health, which governs the coaching relationship.

9. Acceptable use

You agree not to:

• Break the law or violate anyone's rights while using the App.
• Access or try to access another person's account or data.
• Interfere with, overload, or disrupt the App, or get around its security.
• Copy, scrape, reverse engineer, or resell the App, except as the law allows.
• Upload malicious code, or use automated tools to access the App.
• Use the App to create harmful, abusive, or unlawful content, or try to make the AI features do so.

10. Other companies' devices and services

The App refers to devices and services such as Strava, Garmin, Oura, Apple Watch, WHOOP, Fitbit, and COROS only to help you find your own numbers. Flower Power Health is not affiliated with, endorsed by, or sponsored by any of these companies. Their names and trademarks belong to their owners. The App does not connect to these services, and your use of them is governed by their own terms.

11. Fees

Power Source is currently free to use during our pilot. If we introduce fees, we will tell you in advance, and you can choose whether to continue.

12. Changes to the App

Power Source is new and still changing. We may add, change, or remove features, and the App may sometimes be unavailable. We will try to give you notice of significant changes.

13. Our intellectual property

The App, including its design, illustrations, text, software, and the Power Source and Flower Power Health names and logos, belongs to Flower Power Health or its licensors. We give you a personal, limited, non-exclusive, non-transferable license to use the App under these Terms. We reserve all other rights.

14. Feedback

If you send us ideas or feedback, we may use them without obligation to you.

15. Privacy

Our Privacy Policy and Consumer Health Data Privacy Policy explain how we handle your information. They are part of these Terms.

16. Ending your use

You can stop using the App and delete your account at any time in Settings. We may suspend or end your access if you break these Terms, if required by law, or if we stop offering the App. If we stop offering the App, we will try to give you reasonable notice. Sections that by their nature should continue (for example, Sections 3, 13, and 17–21) continue after your use ends.

17. Disclaimers

The App is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise any particular health, fitness, or performance results.

18. Limitation of liability

To the fullest extent the law allows, Flower Power Health will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the App.

19. Indemnification

You agree to defend and indemnify Flower Power Health against claims arising from your misuse of the App or your violation of these Terms, to the extent permitted by law.

20. Governing law and disputes

These Terms are governed by the laws of Oregon, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at elizabeth@flowerpower.health so we can try to resolve it informally.

21. Changes to these Terms

We may update these Terms. We will post the new version with a new date. If a change is significant, we will tell you by email or in the App before it takes effect. If you keep using the App after changes take effect, you accept the updated Terms.

22. General

These Terms, with our Privacy Policy, are the entire agreement between you and us about the App. If any part is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver. You may not transfer these Terms; we may transfer them in connection with a merger, acquisition, or sale of assets.
